MICHIGAN GUARDIANSHIPs
Michigan Guardian. A guardian is a person who has legal responsibility for another person’s physical well-being by handling issues such as housing, medical care, and the provision of basics such as clothing and food.
Michigan Guardianships for Disabled Persons. Under Michigan law, guardianship for individuals with developmental disability shall be utilized only as is necessary to promote and protect the well-being of the individual, including protection from neglect, exploitation, and abuse.
Michigan Testamentary Guardianships. A testamentary guardian is one provided for in the will of a parent to be responsible for a minor child or a disabled adult child. As with a general guardian, the testamentary guardian is responsible for the child’s physical well-being.
Partial Guardianships. The court can limit the guardianship based on the abilities of the disabled adult. Because a guardianship takes away many rights of the individual, a partial guardianship is the preferred form of guardianship for an individual with a developmental disability.
MICHIGAN CONSERVATORSHIPS
Michigan Conservator. A conservator is appointed by the court to manage the estate, property, or other business affairs of an individual whom the court has determined is unable to properly take care of his affairs himself, because of incapacity, disability or age. Under Michigan law the conservator of an estate may expend or distribute estate income or principal without court authorization or confirmation for the support, education, care, or benefit of the protected individual or the protected individual's dependents.
